저작권 그 자체는 저작권자의 권리 보호 및 저작권자의 권리 보호를 통한 저작물의 유통 혹은 소비 증대를 위한 권리입니다.
그러므로 저작권법은 반드시 저작권자만을 위한 법으로만 볼 수는 없습니다.
예컨데, 모두가 공유할만한 훌륭한 저작물을 그 저작권자가 공개하지 않을 경우에 우리는 어떠한 태도를 취해야 할지 고민해봐야 합니다.
예를 들어 모나리자를 소유한 권리자가 그 작품을 더이상 모두에게 공개하지 않겠다고 선언하고 폐기처분하겠다고 할 경우 그것을 용인해야 하는 것인지 알 수 없습니다.
훌륭한 작품은 저작권자만의 소유물로 인정되어서는 곤란합니다만, 자본주의 사회에선 명백히 사적 소유가 인정되는 만큼 제 아무리 훌륭한 문화유산이라도 소유자가 페기하려고 하면 못할 이유는 없을 것입니다.
물론, 중요한 국가적 유산인 경우엔 문화재보호법 등으로 개인의 권리를 제한하고 있을 것입니다.
최근 저작권법이 무시되고 불법 유통이 확산되면서
시장 내에서는 자연스럽게 공유에 대한 요구의 목소리가 높아지고 있습니다.
저작권자의 이익도 보호하면서 다수 대중이 저렴한 비용으로 콘텐츠를 즐길 수 있는 지혜로운 해법이 필요한 시대입니다.
저작권자가 일방적으로 자신의 작품에 대한 권리나 가격만을 주장하는 것이 아니라, 모두가 수용할 수 있는 현명한 대안이 필요한 때입니다.
웹2.0의 참여, 공유, 개방의 정신이 어떤 식으로든 해법을 제시하지 않을까 판단됩니다.
